Terms of Service

The terms that govern motionpls.com and paid work ordered from MotionPls.

Effective August 22, 2026Operated by Prodmake LLC

1. Who these terms are with

MotionPls is a service operated by Prodmake LLC. These Terms of Service (“Terms”) govern your use of motionpls.com and any service you purchase directly from MotionPls. By using the website or placing an order, you agree to these Terms.

You must be at least 18 years old and able to enter a binding agreement. If you act for an organization, you confirm that you have authority to bind that organization.

2. The service

MotionPls provides managed, art-directed motion design through fixed packages and separately scoped custom projects. The package or written scope confirmed before payment defines the communication job, duration, concepts or variations, included formats, and one consolidated revision.

The package or written scope confirmed before payment, the approved story or script, and any written scope agreed with you form part of the service agreement. Work outside that scope requires another package, an addition confirmed in writing, or a custom project agreement.

3. Orders, prices, and payment

Prices are displayed in United States dollars unless stated otherwise. You agree to provide accurate billing and contact information and to pay applicable taxes or charges presented before payment. Payment may be processed by Stripe, PayPal, or another payment provider identified on the payment link we send you or show on our website. We do not receive or store your complete payment-card number.

An order is not active until payment succeeds. A payment receipt does not mean that an incomplete, unlawful, unsafe, or out-of-scope request has been accepted for production. If we cannot accept the request, the applicable refund terms below apply.

4. Your brief, materials, and approvals

You are responsible for providing:

  • a clear objective, audience, intended channel, and accountable decision-maker;
  • complete and accurate source material, claims, names, pronunciations, and legal language;
  • usable brand assets and files you have the right to provide and use; and
  • timely, consolidated approvals and feedback.

You remain responsible for the accuracy and legality of product, policy, medical, financial, political, regulatory, and other material claims. Approval of a script or first cut confirms that you have reviewed the material and authorize us to proceed on that basis.

5. Timing and delivery

Production begins only after successful payment, complete intake, usable assets, and story or script and factual-claim approval. We confirm timing after reviewing those prerequisites. Time spent waiting for customer material, decisions, or approvals pauses the production schedule.

Delivery is digital. A fixed package includes the commercial-use masters, variations, cutdowns, and formats named in its confirmed scope, not source project files, production code, internal tools, or editable compositions. See ourDelivery Policy for details.

6. Revisions and scope changes

One consolidated revision means one batch of feedback submitted by one accountable decision-maker within the approved objective, audience, concept, and narrative. Corrections for errors caused by MotionPls do not consume that revision.

A new audience, objective, narrative, concept, or material change to approved facts or source material may require a new order or separately priced scope. Additional paid changes begin only after we review and confirm their scope.

7. Cancellation and refunds

You may request a full refund before approving the script. After script approval and the start of production, payments are non-refundable except where MotionPls cannot perform the order or applicable law requires otherwise. See our Refund Policyfor the complete conditions and request process.

8. Customer materials

You retain ownership of materials you provide. You grant Prodmake LLC a limited, non-exclusive license to host, copy, adapt, and use those materials only as needed to evaluate, produce, review, deliver, secure, and support the ordered work.

You represent that you have all rights and permissions required for the materials and instructions you provide. Do not submit regulated, restricted, classified, export-controlled, or highly sensitive information through the intake without a separate written agreement.

9. Final work and retained materials

After full payment, you receive commercial-use rights to the approved final render. Any customer-owned trademarks and source materials remain yours. Prodmake LLC retains its pre-existing materials, production methods, source files, code, templates, tools, reusable systems, know-how, and any general improvements that do not disclose your confidential material.

We will not publish your commissioned work as a portfolio example without your written permission. Third-party fonts, music, stock, software, and other licensed materials remain subject to their applicable licenses.

10. Acceptable use

You may not use the website or service to:

  • violate law, regulation, sanctions, intellectual-property rights, or privacy rights;
  • create deceptive, defamatory, abusive, exploitative, or unlawfully discriminatory material;
  • impersonate another person or misrepresent authorization, evidence, or claims;
  • introduce malware, disrupt the service, scrape it abusively, or test its security without permission; or
  • submit material you are not authorized to disclose or use.

We may refuse or stop work that reasonably appears to violate these restrictions.

11. No performance guarantee

We provide a creative production service. We do not guarantee views, engagement, leads, conversions, revenue, regulatory approval, platform acceptance, or any other campaign or business result. You are responsible for publication, media buying, distribution, and final legal or compliance review unless a written scope expressly says otherwise.

12. Disclaimer

To the maximum extent permitted by law, the website and service are provided “as is” and “as available.” We do not warrant uninterrupted website access, compatibility with every device or platform, or results beyond the agreed deliverables. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Prodmake LLC will not be liable for indirect, incidental, special, punitive, or consequential loss, or for lost profits, revenue, data, goodwill, or business opportunity arising from the website or service. Our total aggregate liability for a paid order will not exceed the amount you paid for that order.

These limits do not apply where liability cannot legally be limited, including liability for fraud, willful misconduct, or other non-excludable obligations.

14. Governing law and disputes

These Terms are governed by the laws of New Mexico, United States, without regard to conflict of law rules. Before filing a claim, please contact us and allow a reasonable opportunity to resolve the issue informally. Any claim not resolved informally may be brought in a state or federal court with jurisdiction in New Mexico. These Terms do not require arbitration.

15. Changes and severability

We may update these Terms prospectively by posting a revised version and effective date. Terms in effect when you place an order continue to govern that order unless a change is required by law or you agree otherwise. If one provision is unenforceable, the remaining provisions remain effective.
